1. Acceptance of Terms

By installing and using egg email, you agree to these Terms of Service. If you do not agree to these terms, please do not install or use the app.

2. Service Description

egg email provides email revenue activation services for Shopify stores, including:

• 5 proven email revenue flows written in your brand voice
• Automated email sending and tracking
• Revenue attribution by flow
• Performance analytics

3. Pricing and Billing

egg email pricing:

• Revenue Activation: $49 one-time charge (billed through Shopify)
• Keep egg email on: $29.99/month (billed through Shopify)

You can cancel anytime and keep all your custom-written email copy.

4. Your Responsibilities

You are responsible for:

• Ensuring compliance with all applicable email marketing laws (CAN-SPAM, GDPR, CASL, etc.)
• Only sending emails to customers who have opted in to receive marketing communications
• Honoring unsubscribe requests (we handle this automatically)
• The accuracy and legality of your store's content and products
• Maintaining the security of your Shopify account

5. Prohibited Uses

You may not use egg email to:

• Send spam or unsolicited emails
• Distribute malicious content
• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others

6. Intellectual Property

egg email retains ownership of the software and service. The email content generated for your store belongs to you and can be used even after cancellation.

7. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability.

8. Limitation of Liability

egg email is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to lost revenue, lost profits, or data loss.

Our total liability to you for any claims related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Data and Privacy

Your use of egg email is also governed by our Privacy Policy. We comply with GDPR and handle all data responsibly.

10. Termination

You may terminate your use of egg email at any time by:

• Uninstalling the app from your Shopify store
• Canceling your subscription through Shopify

We reserve the right to suspend or terminate your access if you violate these terms.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email or through the app. Continued use of the service after changes constitutes acceptance of the new terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws applicable in your jurisdiction. Any disputes arising from these terms or your use of the service shall be resolved in accordance with the dispute resolution mechanisms available in your location.
